Creditor restrained from harassing borrower
08-Jul-2009 Judge Halbert at Chester County Court has granted an interim injunction in favour of our client, Mr Simms, restraining The Funding Corporation, a creditor, from harrassing him for payment of an unfair debt, or from enforcing the debt, or communicating with him except by correspondence through ourselves, pending a final decision in his case. Mr Simms is bringing a case against the Funding Corporation, who traded as Welcome Car Finance, for a variety of unfair practices to which they subjected him, including misselling payment protection insurance, unfair charges, and unfair enforcement practices. Mr Simms relies on the new law of Unfair relationships introduced by the Consumer Credit Act 2006.Aegis Law is registered with the Solicitors Regulation Authority, registration number 388682.
